Chapter 11 is a plan in the Bankruptcy Code in most cases known to be appropriate for businesses like corporations, partnerships or sole proprietors because of the complexity and length of the procedures as well as the fees involved. In addition, you will discover distinctions for the procedure for the three classes of debtor. Much like other bankruptcy programs, individuals, or husband and wife, electing chapter 11 bankruptcy must undergo credit counseling. Corporations’ personal assets are not associated with chapter 11 bankruptcy proceedings apart from the stocks belonging to the company, but partnerships might find personal assets involved and sole proprietors can anticipate both personal and business assets being susceptible to rulings. Cases specified as ‘small business’ could proceed at more rapid pace and be subject to a lesser number of official demands than other cases, but as a small business debts must be below roughly $2.2 million and also have no creditors’ committee involvement.

Filing under chapter 11 may be at the debtor’s discretion or it might be an involuntary petition filed by creditors. All debtors are required to produce to the court with complete disclosure statements of all debts and assets (although the extent of the disclosure statement varies depending on the type of debtor) and pay fees of more than $1000 along with a repayment or liquidation plan.

Filing a voluntary chapter 11 petition means the debtor continues to be in charge of the business and is known as the ‘debtor in possession’. The debtor in possession has sizeable responsibilities to look after and move the case along. Tardiness can have negative consequences. A US trustee maintains a close supervisory role in the case in relation to the operation of the business requiring reports on all endeavors including operating expenses and income. The US trustee can have the case converted under the Bankruptcy code in the situation that the debtor in possession be found to negligent in proceeding with confirmation of a plan or else neglect to report adequately for the activities of the business. Additionally the us Trustee is paid by the debtor in possession.
Additional officials could possibly be involved in an in-depth on-going chapter 11 petitions such as a case trustee or an examiner who works with the trustee. Creditors’ committees may be formed of unsecured creditors to cooperate with the debtor in possession and might also hire other specialists with the courts discretion.

Chapter 11 requires that a repayment plan must set out what types of claims are to be dealt with and exactly how they will be addressed. The plan combined with the disclosure statement have got to provide sufficient information for creditors to determine the viability of the plan. There is a possibility to vote by ballot for those creditors who may not necessarily foresee full repayment under the plan. Additionally, creditors are capable of providing alternative plans.

After filing, you have the normal period where an automatic stay will come in to act with regard to the actions of most creditors. However, some secured creditors can petition the court for the right to foreclose on property under special circumstances like in the case of single asset real estate debtors. This sort of action on by way of creditors along with other possible motions related to stays can be forestalled by the confirmation of a plan or commencement of repayment of interest on debt to the creditor.

Adherence to the requirements of a confirmed plan in most cases leads to discharge of debts accrued before confirmation. But, under chapter 11, only individuals are granted discharge as a result of confirmation to a liquidation plan.

Qualify Mortgage

Qualify Mortgage

One of the most critical elements of human existence is reliable shelter. Housing is an integral part of development and is a necessary requirement for a functional economy. The demand for housing is so high that it has pushed the cost of owning a house well beyond the reach of many. For this reason, millions of people are living in informal settlements, especially in developing countries. The situation is however no different even in developed countries. This is why the provision of basic shelter was ear marked as one of the millennium development goals.

The crashing of the world markets due to the global credit crunch has not made things any easier. Real estate is touted as one of the root causes for the entire crisis, based on the over pricing in some of these countries to cash in on the demand and easy credit. Some of the people that took mortgages have been thrown out of their homes for failing to pay the monthly premiums. This has caused many eligible mortgage takers to sit back and re-examine their situation to make sure they don’t fall into the same trap. To understand the mortgaging process, it is important to understand what the requirements of the industry are.

For you to qualify for a mortgage, one of the things that must be easily done is the estimation of your income. Mortgages are generally based on a predictable revenue stream. They will examine your stated income and all its sources. Some of the sources could include salary from employment, annual bonuses, commissions and many more. Sources such as bonuses and commissions carry little weight since they can fluctuate from year to year. However, if you are able to substantiate sustained income from bonuses and commissions over a reasonable length of time, it might work well for you. Overall, nothing trounces a weight of the salary since it is almost always guaranteed at the end of the month.

In line with you salary, the mortgaging company may also want to know more about your employment history. If you have shown that you cannot hold a job for more than 6months, then the level of risk in lending to you is too high. Remember that lending is based on the ability of the lender to predict your income stream. Having a checkered employment history is an issue that may play to your disadvantage. Having a great employment record i.e. working in an organization for a decent number of years before moving to the next, will greatly increase you chances of getting that mortgage.

They will also look at your personal assets. This means anything of financial value that you own. The purpose of this is to ensure that they can attach these properties to act as collateral for the mortgage or can be auctioned in the event that you default on paying your monthly premiums. They also want to see if you are a man/woman of means. The more financially valuable properties you have, the better the chances of securing that mortgage.

Mortgages, just like any other kind of lending, are all about ascertaining risks and lending based on those risks. Income estimation, background information on employment history and assessment of personal assets are all steps taken to ensure that the risk in lending to you is minimized.

Down Payment Savings

Down Payment Savings

Potential home buyers who can make a house payment with no difficulty sometimes can’t buy a house because they don’t have the funds required for a downpayment and closing costs. One solution to the problem–use a downpayment gift assistance program, sometimes called a downpayment grant program.

Waiting until you have a sizable down payment can save you thousands every year and provides a cushion a new homeowner might need.

“Some couples can afford the house when they’re both working, but if a kid comes along and one wants to stop working, then they have a problem,” says Michael Eisenberg, a CPA and personal financial specialist in West Los Angeles, Calif. Even in his area, where starter homes cost a lot more than $350,000, he recommends that young couples “sit back, stay renting and save your money for your down payment.” If your rent is reasonable and the housing market in your area has slowed, there’s even less reason to rush into buying.

“In the early years, you aren’t building any equity with the mortgage payment,” Eisenberg says. “If the market changes or your personal circumstances change and you’re forced to sell, you could lose money” if you made little or no down payment. The equity in your home can also give you an extra source of cash in an emergency.

Sellers are not allowed to give home buyers downpayment funds. That’s where gift assistance programs step in, providing a “work around” of those laws. 20% is required to avoid paying monthly PMI (monthly mortgage insurance) but I have recently obtained financing for my clients on conventional loans with as little as 5% down. It really depends on your credit score. If your FICO score is less that 700 you can expect to be required to put down 20%. How much do I need for down payment for a conventional mortgage loan. Your insight into what would be the best way to proceed would be much appreciated.  A little advice would go a long way right now. I am very grateful for your help.

Downpayment gift or grant assistance programs help home buyers close on a home by providing funds for downpayment and closing costs. Find out how they work and how you can take advantage of a gift assistance program.

Depending on your situation, these questions may vary somewhat, but generally speaking, all prospective borrowers should consider these items at a minimum.

1)  What steps are necessary to “pre-qualify” for a mortgage loan from this lender?  Are there any costs involved during the pre-qualification process?  (e.g. credit report, etc)

2)  Assuming you pre-qualify, what interest rates are available for fixed rate and variable rate mortgages?  Do these rates require a certain down payment, periods of time for repayment?  Is there a pre-payment penalty for any of these offers?

3)  With the recent stimulus package that was passed by Congress, are there any incentives or tax breaks that I may qualify for?

4)  If this is your first home purchase, are there any FHA loans that I may qualify for?  What are the circumstances under which I may be required to purchase mortgage insurance for the lender?

5)  Does this lender have a recommendation on who to work with to procure a title insurance policy for the property you’re considering purchasing?  Often times, the lender may help you get title insurance at a discounted price.  It never hurts to ask, you can always select your own, if you wish.

6)  Last, but not least, are there any other costs associated with the mortgage transaction that have not been fully disclosed or that I may not be aware of?  Please be advised that this is always the most important question.  If takes away the opportunity for the lender to “forget” to mention any associated fees, whether intentional or not.

Getting a mortgage

Getting a mortgage

Mortgage interest rates are calculated on the basis of your monthly payments towards the loan. If you know basics of mortgage and how to calculate the interest rate, you can save some money on your mortgage.

You normally accept mortgage through a local bank or through a lender. But these banks and lenders do not set the mortgage interest rates. Federal Reserve Bank decides the interest rate. Lenders watch the interest rate on ten years bonds. When the yield on ten year bonds change, the interest rate will also change. For a home buyer, the mortgage interest rate depends on factors like closing costs, down payments etc.

There are different types of mortgages. For example, fixed rates mortgages are the one, where the interest rate and the payment will remain the same. In adjustable mortgage, monthly payment changes according to the interest rates.

Mortgage interest rates are also determined by the stock market. If the stock market goes up, the interest rate also goes up. If the stock market crashes, the interest rate will also come down. Another factor that determine the mortgage interest rate is your past credit history. Lender will check the past credit history and also risk of defaulting. If you have a good credit history and a secure job, you can obtain a loan for a fairly low interest rate. The higher the risk, the higher the interest rate will be.

The other factor that determining the mortgage rate by the banks are by loan to value ratio (ltv), by which the bank will give a certain percentage as loan to the actual value of the home. The bank will have less risk by putting more money on homes. In this case the interest rate will be low.

How much you afford depends on how much you can borrow and how much down payment can you make. These two are inter-related which affects the mortgage equation. Many people are in a hurry to sign up for a mortgage without considering the years of financial obligation they are taking on and what impact it will have on their financial condition later on. Mortgage lenders use a mortgage formula to see your monthly mortgage payment come in at less than 28% of your gross income and your total monthly debt payments, including your mortgage, will be less than 36% of your gross income.

A mortgage calculator will help you with a number of statements for you to rate, to help focus on what you want and then suggests approaches for you to assess. Mortgage calculator will tell you how much you can borrow, but they wouldn’t tell you the best way to get the home you want and there are other approaches that may be better for you.

First thing you need to do is to determine your gross monthly income, which is the income you have before you pay taxes and other expenses. If you are married, you can apply for the loan jointly by adding both the income of husband and wife. Next step is to determine your total non-mortgage debt payments such as monthly credit card or car loan repayment etc. Using mortgage calculator you can calculate how much loan you can afford to take considering your repayment capacity.

Remember one thing. Just because the bank is ready to give you loan doesn’t mean that you can really afford to take the loan amount. In reality your specific situation will dictate what type of home and mortgage payment will be best for you.

The last thing a borrower should consider is how comfortable they are with assuming  a large amount of debt and the monthly payment obligations. Before you apply for a loan, you should make some level of estimate of how much you spend on a monthly basis to maintain the life-style that you wish to live. Evaluate this against the monthly housing and debt obligations as well as your take home income. If there is not enough money left to meet the debt obligations and still you wish to have the life style you want, then you may reconsider taking a loan.
